      Declaration, in order to obtain the benefit of the act of Congress of the 7th June 1832

      On this 4th day of June 1834 personally appeared before William S. Ross Esq., one of the Judges of the Court of Common Pleas of said County, Abel Patrick, a resident of Falls Township in said County, too infirm by reason of a long debility by palsey to attend the Court of Common pleas aforesaid, wo being first duly sworn by the said Judge according to Law on his oath, doth make the following declaration, in order to obtain the benefits of the provision made by the act of Congress passed June of 1832 --
      That he was born on the 15th of April 1757 at Norwalk, Fairfield County, State of Connecticut--that he has now no record of his age --
      March 1, 1776 he enlisted in Captain Nathan Burrills Company of state Troops, at Norwalk aforesaid in Connecticut for a term of nine months. Said company was attached to Colonel Ozias Marvins Regiment--Asher Taylor was 1st Lieut., Thoms. Hiatt was drummer. Was generally stationed at Sawgatuck in the same county, that after the time of his enlistment had expired he was discharged, verbally, and returned home--during s . . . [sad term?] he was in no engagement.
      That on the March following 1777 he enlisted at Norwalk aforesaid in the team service for a period of six months that he was engaged during the whole of said term at Fishkill on the North river--was under the direction of Copl. Jonathan Squires --at the end of Six months he was verbally discharged and returned home
      That in 1779 he thinks about the 1st of August he was drafted for a period of nine months, at Norwalk aforesaid--in Capt. Eliakim Smith's company of State Troops, 1st Lieut. Stephen Hugh, drummer, Samuel Stewart--said company was attached to Colonel Stephen St. John regiment. He marched to Middlesex--that in some time in the last of October 1779 while on guard he was taken prisoner by the Brittish and carried to Long Island where he was confined for a period of about six months, when he escaped and returned home, where he remained till 1794 when he removed to Falls Township in said County of Luzerne, where he has since lived--and for the four last years he has been entirely helpless by an attack of the palsey,--He hereby relinquishes every claim whatever to a pension or an annuity except the present, and he declares that his name is not on the pension roll of any agency in any state--
      He would refer to John Ager, Caleb Avery, Azor Philo and the Rev. Newton Smith to testify as to his character for veracity and their belief of his service as a soldier of the Revolution--

      Newton Smith, a clergyman, aged 62 years and upon being duly sworn says he resides in Eaton adjoining Falls, that he has known Abel Patrick, the above applicant for twenty years and upwards--that he has full confidence in the facts contained in the above declaration--and believes him to be a man of truth and veracity--and that he believes him to hve been in the service as stated in the above declaration--

      Azor Philo, John Agar and Caleb Avery, residents of Falls--being duly sworn--certify that they are well acquainted with Abel Patrick above named, and who has sworn and subscribed to the above declaration that we believe him to be seventy seven years of age, that he is reputed and believed in the neighborhood where he resides to have been a revolutionary soldier and that we concur in that opinion and also believe him to be a person of trust and veracity.

      State of Pennsylvania, Luzerne County
      I. William S. Ross, one of the Judges of the Court of Common pleas of said county do certify the foregoing contains the original proceedings in the matter of the application of Abel Patrick for a pension--And I do also declare my opinion after putting the interrogatories perscribed by the war department that the above named applicant was a revolutionary soldier and served as he states; and I do further certify that it appears to me that Newton Smith who has signed the preceding certificate is a clergyman residing in Eaton and that Azor Philo, Caleb Avery and John Ager who have also signed the foregoing certificate are residents of Falls and are all creditable persons and that the statement is entitled to credit--and I do also further certify that Abel Patrick the applicant above named, byreason of extreme bodily infirmity is unable to attend court.
