      Letters Testamentary:
      On reading and filing the application of Amzi L Smith, Executor named in the Last will and testament of Jess Smith, late of the town of Monroe in the County of Orange deceased for the proof of said will as a will of Real and Personal estate. It is ordered that the following citation viz:
      The people of the State of New York to Martha Smith, the widow, Jesse Smith of the Town of Monroe, Stephen B Smith of the town of Goshen, all of the County of Orange, William F Smith of Morristown in Morris County in the state of NJ, Ira Smith of Sandusky Co, State of Ohio, town unknown, the next of kin of Jesse Smith, late of the town of Monroe in the County of Orange deceased. Greeting: You are hereby cited to be and to appear before the Surrogate of the County of Orange, at his office in Goshen, in said county on the twenty-eighth day of November next at ten o'clock in the forenoon of that day, to attend the probate of a certain instrument in writing purporting to be the Last Will and testament of said deceased bearing date the eighteenth of February in the year of our Lord one thousand eight hundred and forty-two on the application of Amzi L Smith claiming to be executor thereof which said will relates to both real and personal estate...
      Will:
      In the name of God Amen
      I Jesse Smith of the town of Monroe County of Orange and State of New York, considering the uncertainty of this life and being of sound and perfect mind and memory (Blessed be almighty God for the same) do make and publish this my last Will and Testament.
      First I will and order that all my lawful debts and funeral charges be paid out of my personal property. To my beloved wife Martha, I give, in Lieu of lawful dower the use of my homestead farm during her natural life, including the premises in which I now live and the lot of land which I purchased of Elisha Pinkney, also parcel of land which I inherited from my father.
      Further I give to my wife, one years provision from my decease. Also one cow, two feather beds and bedding sufficient for summer and winter including with them the bedsteads, cords curtains and straw ticks, her choice of one of my tables and light stand, six chairs, six cups and saucers, six knives and forks, one tea kettle, two brass kettles, one frying pan, one iron pot, one pair of brass andirons, shovel and tongs, two brass candlesticks, one carpet, one bureau, one wash tub and any other articles of household stuff which shall be necessary for her to have for keeping house comfortable. To have and to hold the before mentioned articles unto her the said Martha and her heirs forever. I also give unto my wife the use of my best clock through her lifetime and at her decease I then give it to my son Jesse to his use and disposal forever.
      To my beloved son Amzi I give and bequeath all that parcel of my freehold estate lying in the town of Warwick called the Fitzgerald farm containing about seventy two acres of land together with all the appurtances thereto belonging. To have and to hold the same to Hirn and his heirs forever upon the consideration that he the said Amzi shall pay or cause to be paid to my beloved son Ira the sum of six hundred and twenty five dollars lawful money of the State of New York within fifteen months from my decease. To my beloved son Jesse I give one cow, Also I give and bequeath to my son Jesse at the decease of his mother my homestead farm including the premises on which I now live, the lot of land which I bought of Elish Pinkney and the parcel of land I inherited from my Fathers estate. To have and to hold the same with all the appurtenances thereunto belonging to him the said Jesse, his heirs and assigns forever upon the consideration that he the said Jesse shall pay or cause to be paid my grandson David Smith ( the son of William F Smith) the just and lawful sum of five hundred Dollars on his coming of age. Also to my grandson Abner ( the son of Stephen B Smith) the just and lawful sum of five hundred dollars on his becoming of lawful age. In case either or both the above named grandsons should be of lawful age at my decease, then in that case the several sums to be paid to them within fifteen months from my death.
      To Martha Cox, (a girl which I brought up) I give one cow and a good feather bed and sufficient bedding for summer and winter including also a bed stead, cord and straw tick.
      As to my farming utensils stock and household stuff not otherwise disposed of and all my personal property I will and order my executors to sell same at public venue excepting my wearing apparel which I leave to my wife requesting her to dispose of them among my children as she pleases.
      If at my decease I should have money on hand or ay use I order my executors to put the same with the money arising from the residue and after paying my debts and funeral charges and the expense of settling my estate Then of the residue I give my sons William F and Stephen B two dollars each, and all the rest, residue and remainder of my estate whether personal or real I give it equally to my two sons Amzi and Jesse, their heirs and assigns forever. As to a certain sealed obligation which I hold against my son Ira of one hundred and seventy five dollars i will and order that the same be not collected but that my executors give up the same to my said son Ira. Lastly it is my wish that my son Jesse should work and carry on my homestead farm as a tenant under hid mother, and furthermore it is my will that my son Jesse should have the privilege of making any improvements upon the farm which he may think proper at his own expense during the lifetime of his mother. I do hereby revoke all former wills by me made and appoint mu beloved wife Martha Smith and my beloved son Amzi Smith Executors of this my Last will and testament. In witness whereof I have hereunto set my hand and seal this eighteenth day of February in the year of our Lord one thousand eight hundred and forty two. Jesse Smith
